Holding
Anticipatory bail was denied to the petitioner.
Summary
The petitioner, Raja Singh, sought anticipatory bail after a police raid on his residence recovered a country-made katta and six live cartridges, invoking Sections 25(1‑B)a and 35 of the Arms Act. The prosecution alleged that the seizure was based on secret information and highlighted the petitioner’s two prior criminal convictions. The court examined whether the seriousness of the alleged offence, the nature of the seized arms, and the petitioner’s antecedents justified denial of anticipatory bail. It held that the presence of illegal arms and the petitioner’s criminal record warranted a denial of bail. Consequently, the petition for anticipatory bail was rejected.
