The Court granted anticipatory bail to the petitioner subject to specified conditions.
Summary
Guddu @ Shyam Bihari Gupta was implicated in a case involving the seizure of 270 litres of illicit spirit and alleged offences under the Bihar Prohibition and Excise Act and several IPC sections. He contended that he was not present at the scene and that the only basis for his implication was a confessional statement of a co‑accused, with no material recovered from his possession and alleged non‑compliance with mandatory recovery procedures under Section 100 of the CrPC/Section 103 of the BNSS, 2023. The State opposed bail, invoking Section 76(2) of the Bihar Prohibition and Excise Act, arguing that pre‑arrest bail was not permissible. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar (2019 PLJR 1089), the Court granted anticipatory bail, imposing a bond of Rs 10,000 with two sureties and several conditions regarding cooperation, non‑tampering with evidence, and verification of antecedents.
Issues considered
- Whether anticipatory bail should be granted despite the seriousness of the offences alleged under the Bihar Prohibition and Excise Act and IPC.
- Whether the procedural lapses in the recovery of the illicit spirit under Section 100 CrPC/Section 103 BNSS, 2023 affect the validity of the charge.
- Whether Section 76(2) of the Bihar Prohibition and Excise Act bars the grant of pre‑arrest bail.
