Holding

Regular bail was denied because the large quantity of seized codeine cough syrup indicated the seriousness of the offence.

Summary

The petitioner, Rajiv Ranjan Kishore, applied for regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act for possession of a large quantity of codeine cough syrup. The prosecution alleged that 3,149 bottles of 100 ml codeine cough syrup were recovered from the petitioner and co‑accused, and the petitioner had been in custody since 5 May 2026. The court examined whether the seriousness of the seizure warranted denial of bail. Considering the massive quantity of contraband, the court was not inclined to grant regular bail. Consequently, the bail application was dismissed, with the court noting that its observations were prima facie and limited to the bail application alone.
