Patna High Court

Sazzo KhatoonversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the petition for regular bail and ordered the petitioner’s release on bail.

Summary

The petitioner, Sazzo Khatoon, was arrested on 4 April 2026 in connection with offences under the Bihar Narcotic Substances Act, the POCSO Act, the Immoral Traffic (Prevention) Act and the Bihar Prohibition and Excise Act, alleged to be involved in a prostitution business. She applied for regular bail, claiming innocence, a clean antecedent and willingness to cooperate with the trial. The State, represented by the Additional Public Prosecutor, opposed the bail. The Court examined the nature of the charges, the petitioner’s custody duration, and her personal circumstances. Considering the facts, the Court found no compelling reason to deny bail and ordered her release on regular bail with a cash bond and sureties. The bail order was pronounced by Justice Sandeep Kumar.

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under Sections 111, 98, 99, 70(1), 115(2), 143 and 3(5) of the Bihar Narcotic Substances Act, Sections 4 and 17 of the POCSO Act, Sections 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act and Section 30(a) of the Bihar Prohibition and Excise Act.
