Decided

DISMISSED

Holding

Anticipatory bail was denied because the allegations involved serious offences warranting the petitioner’s surrender and regular bail proceedings.

Summary

The petitioner, Ravi Kumar, sought anticipatory bail fearing arrest in connection with a case registered under Section 27 of the Arms Act and several sections of the Indian Penal Code for allegedly firing at individuals, causing injuries. The prosecution alleged that the petitioner fired in the air and subsequently shot at a person named Nitish Kumar, with medical evidence supporting the charges. The court examined whether the seriousness of the allegations justified granting anticipatory bail. Considering the nature and gravity of the offences alleged, the court was not inclined to grant such relief. Consequently, the application for anticipatory bail was dismissed and the petitioner was ordered to surrender within four weeks and apply for regular bail, failing which the police would be directed to arrest him.
