Golu KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Anticipatory bail was denied as the petitioner was found to be tampering with evidence and the allegations were serious.

Summary

The petitioner, Golu Kumar, was accused of molesting a 13‑year‑old girl under multiple provisions of the Bihar Penal Code, the POCSO Act and the SC/ST Act. He applied for anticipatory bail, claiming that the parties had settled the dispute, a view supported by the informant's counsel. The court, however, found that the petitioner was tampering with evidence and considered the allegations serious. Consequently, the court refused to grant anticipatory bail and dismissed the application. The petitioner was ordered to surrender within four weeks and seek regular bail, failing which the police were directed to arrest him.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the serious charges and alleged tampering with evidence
  • Whether a settlement between parties affects the grant of anticipatory bail
