Patna High Court

Nikku KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that regular bail is warranted where the injury is simple and there is no substantial reason to deny bail, and thus allowed the bail application.

Summary

The petitioner, Nikku Kumar, was arrested in connection with a case registered under several sections of the Bihar Penal Code for allegedly assaulting an informant's father with a lathi-danda and pistol butt, causing a simple head injury. He had been in custody since 21 February 2026 and claimed innocence, asserting that the injury was minor and that a co-accused had already been granted anticipatory bail. The State opposed the bail application, but the court considered the nature of the injury and the circumstances of the case. Relying on the principle that bail may be granted when the offence is non‑grievous and the accused is not a flight risk, the court allowed the bail application. The petitioner was ordered to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties of the same amount.

Issues considered

  • Whether regular bail should be granted to the petitioner in view of the nature of the alleged offences and the simple injury sustained by the victim
  • Whether the existence of anticipatory bail for a co‑accused influences the grant of regular bail to the petitioner
