DISMISSED

Holding

The court held that bail could not be granted in view of the seriousness of the offenses and the substantial recovery of arms.

Summary

The petitioner, Pampam Bind, applied for regular bail in a case registered under several provisions of the Arms Act, alleging that pistols, live cartridges, and manufacturing tools were recovered from his residence. The prosecution alleged that these items were intended for illegal arms manufacture. The petitioner had been in custody since March 16, 2026, and it was noted that his father was caught at the scene while the petitioner fled. The court examined the seriousness of the offenses and the quantum of the seized weapons. Considering the gravity of the alleged offenses and the evidence of a substantial seizure, the court declined to grant bail. Consequently, the bail application was dismissed.

Issues considered

  • Whether regular bail should be granted to the accused under Sections 25(1-AA), 26(1), 26(2), 35 and 25(1-B)a of the Arms Act given the nature and quantum of the seized arms.
