Patna High Court

Chandan Das @ Kundan DasversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a Rs.10,000 bond, two sureties, attendance requirements, and antecedent verification.

Summary

The petitioner, Chandan Das, was arrested in connection with a case under Sections 8(c) and 21(b) of the Narcotic Drugs and Psychotropic Substances Act for the alleged recovery of 1.88 grams of a brown sugar‑like substance. He has been in custody since 22 April 2026 and claims innocence, stating that nothing was recovered from his possession. The State opposed his bail application. The Court considered the small quantum of the alleged narcotic and the petitioner’s claim of a clean antecedent, and ordered his release on bail upon furnishing a Rs.10,000 bond with two sureties. The bail was conditioned on the petitioner’s attendance at the police station on the first and third Sundays of each month and on verification of his antecedent, with cancellation of bail for any default.

Issues considered

  • Whether bail should be granted in an NDPS case involving a small quantity of narcotic substance
  • Whether the petitioner’s claim of innocence and lack of possession justify bail
  • What conditions, if any, should be imposed on bail in such circumstances
