Patna High Court

Mithun KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the application for regular bail, granting release on bond with conditions.

Summary

Mithun Kumar was arrested in connection with the seizure of 315 litres of illicit liquor from his vehicle, alleged to be an offence under Section 30(a) of the Bihar Prohibition and Excise Act. He applied for regular bail, claiming innocence and stating that no incriminating material was found on him, while the State opposed bail citing a prior criminal antecedent. The Patna High Court considered the facts, the period of custody, and the nature of the offence, and concluded that bail could be granted despite the antecedent. The Court ordered his release on a bail bond of Rs.10,000 with two sureties, subject to attendance at the police station on specified days and regular participation in the trial. The order was made on a prima facie basis and does not prejudice the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail for an offence under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the petitioner’s prior criminal antecedent precludes the grant of bail.
  • Whether the conditions imposed by the Court are appropriate for the grant of bail.
