Manish Kumar OjhaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner upon furnishing a bond of Rs.10,000 with two sureties.

Summary

Manish Kumar Ojha was arrested in connection with a violent incident alleged to have occurred on 7 December 2024, where he and co‑accused allegedly entered the informant's house, assaulted family members with a gandasa, and stole ornaments. The petitioner sought bail, arguing that the medical report indicated injuries caused by a sharp, pointed object, not a gandasa, and that there were no prior criminal antecedents. The prosecution contended that the injuries were grievous and that the petitioner was directly involved. The court examined the discrepancy in the injury report, the seriousness of the charges under the Bharatiya Nyaya Sanhita, 2023, and the petitioner’s custody since November 2025. Considering the lack of conclusive evidence linking the petitioner to the specific weapon and his clean record, the court ordered bail on condition of a Rs.10,000 bond with two sureties. The bail application was therefore allowed.

Issues considered

  • Whether bail should be granted to the petitioner despite charges of assault, grievous hurt, and theft under the Bharatiya Nyaya Sanhita, 2023.
