Patna High Court

Nikki Devi @ Nikki KumariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to regular bail in the kidnapping case.

Summary

Nikki Devi, the sister of the alleged kidnapper Vicky Kumar, was arrested in connection with a kidnapping case under Sections 96 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and has been in custody since 8 April 2026. She applied for regular bail, asserting her innocence and clean antecedents, while the State opposed the relief. The High Court examined the fact that she is a relative of the main accused but noted that bail is a right and not a determination on the merits of the case. The Court held that the petitioner is entitled to bail, subject to a cash bond and sureties, and imposed conditions of regular appearance and cooperation. Consequently, the bail application was allowed, and the petitioner was released on bail with a bond of Rs.10,000 and two sureties of the same amount.
