Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to specified monetary and attendance conditions.

Summary

The petitioner, Dharmendra Kumar, was arrested in connection with a case involving the seizure of 90 litres of illicit liquor and charged under Section 317(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 30(a) of the Bihar Prohibition and Excise Act. He had been in custody since 18 April 2026 and possessed two prior criminal records. The petitioner claimed innocence and offered to donate Rs. 25,000 to a charitable organization as a condition for bail, while the State opposed the relief. The Court, after considering the seriousness of the offences, the period of custody, and the petitioner’s undertakings, allowed the bail application. The bail was granted on the condition of a Rs. 10,000 bond with two sureties, a Rs. 25,000 donation to Ramakrishna Mission, and mandatory attendance at the police station on specified Sundays, with non‑compliance leading to cancellation of bail.

Issues considered

  • Whether bail should be granted to the accused under Section 317(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 30(a) of the Bihar Prohibition and Excise Act considering the nature of the offence, custody period, and prior convictions.
