An anticipatory bail application becomes infructuous upon the death of the petitioner and must be dismissed.
Summary
The petitioner, Rajeev Kumar, sought anticipatory bail fearing arrest under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 in connection with PS case No. 108 of 2026. The application was filed before the High Court. During the pendency of the petition, the petitioner died. The petitioner’s counsel argued that the death rendered the anticipatory bail application infructuous. The Court held that an anticipatory bail application cannot survive the death of the applicant and therefore has no operative effect. Consequently, the Court dismissed the anticipatory bail application as infructuous.
