Patna High Court

Akhilesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, finding procedural lapses and a clean antecedent sufficient to justify release on bond.

Summary

Akhilesh Kumar was arrested on 17 February 2026 in connection with an excise case alleging violation of Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 for possession of 11.250 litres of Indian-made foreign liquor. The petitioner claimed a clean antecedent and alleged false implication, contending that the seizure was recorded by police witnesses in breach of Sections 103 and 105 of the Bihar Narcotic Substances (BNSS) Act, 2023. The State opposed bail, but the court noted the procedural lapses and the petitioner’s lack of prior convictions. Consequently, the court granted bail on a bond of Rs. 10,000 with two sureties, imposing conditions of cooperation, appearance, and non‑tampering with evidence. The bail order also directed verification of the petitioner’s criminal antecedent without delaying the release.

Issues considered

  • Whether the petitioner is entitled to bail despite the alleged violation of Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
  • Whether non‑compliance with Sections 103 and 105 of the BNSS, 2023, by the investigating police, warrants bail.
  • Whether the petitioner’s clean antecedent and claim of false implication affect the bail decision.
