Patna High Court

Shakti ChaudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted subject to a bond, sureties and specified conditions.

Summary

Shakti Chaudhary was arrested on 13 May 2026 for alleged possession of 92.625 litres of illicit foreign liquor, alleged offences under Sections 30(a) and 41 of the Bihar Prohibition and Excise Amendment Act, 2022. The petitioner claimed innocence, arguing that the liquor was seized from the vehicle and not from his conscious possession and that the seizure list violated Sections 103 and 105 of the BNSS, 2023. The prosecution opposed bail, citing two prior criminal antecedents, though the petitioner was already on bail in those matters. The court examined the facts, the alleged procedural lapse, and the antecedents, and decided to grant bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of antecedents. The order directed that bail should not be delayed for verification purposes.

Issues considered

  • Whether bail should be granted in a case involving alleged possession of a large quantity of illicit liquor under the Bihar Prohibition and Excise Amendment Act, 2022.
  • Whether non‑compliance with Sections 103/105 of the BNSS, 2023 regarding the seizure list warrants denial of bail.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of bail.
