BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to conditions under Section 438(2) CrPC and Section 482(2) B.N.S.S.

Summary

Bikki Kumar applied for anticipatory bail fearing arrest in Pali Police Station Case No. 22 of 2026, which alleges offences under several sections of the Bharatiya Nyaya Sanhita, 2023, including assault and theft of gold ornaments. The petitioner contended that he was falsely implicated, that the alleged injuries to the informant were minor, and that the charge of snatching ornaments was unfounded, asserting a clean antecedent. The State opposed the bail, arguing the seriousness of the alleged offences. The Court examined whether the allegations, taken at face value, warranted denial of bail and considered the statutory provisions governing anticipatory bail. Relying on Section 438(2) of the Code of Criminal Procedure and Section 482(2) of the Bharatiya Nyaya Sanhita, the Court held that bail could be granted subject to strict conditions. Consequently, the petition for anticipatory bail was allowed, with the petitioner required to furnish bail bonds and comply with several conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the CrPC in view of the allegations under the Bharatiya Nyaya Sanhita.
  • Whether the nature of the alleged offences and the petitioner's claim of false implication justify denial of bail.
