DISMISSED

Holding

The application for cancellation of bail is dismissed, leaving the bail order in force.

Summary

The petitioner, Urmila Devi, sought cancellation of the regular bail granted to accused Sumant Kumar Singh (O.P. No.2) in a case involving multiple IPC offences including assault, grievous hurt, kidnapping, and murder. The bail had been ordered on 22‑11‑2024 in Cr. Misc. No.53704/2024. The accused argued that the transfer petition had been dismissed, a statement under Section 313 CrPC had been recorded and the trial was nearing its conclusion, making bail cancellation unnecessary. The petitioner’s counsel expressed no objection to disposing of the application in light of the accused’s submission. The Court, after considering both sides, dismissed the application for bail cancellation and directed the trial judge to avoid unnecessary delays caused by the accused. The order effectively leaves the bail in force while urging speedy trial disposal.
