Patna High Court

Aniket KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

Aniket Kumar was arrested in connection with a case involving alleged theft and sale of electric wires and offences under the Bihar National Security Act, 2023 and the Arms Act. He claimed a clean antecedent and argued that no incriminating material was found on him, only a mobile phone, and that he was neither the owner nor driver of the vehicle used. The prosecution opposed bail, but the court noted that co‑accused persons in similar circumstances had been granted bail. Considering the lack of seized evidence and the petitioner’s clean record, the court ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions regarding cooperation, presence, and non‑tampering with evidence. The bail order also directed verification of his criminal antecedents without delaying the acceptance of the bond.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences under the B.N.S. Act and the Arms Act
  • Whether the absence of incriminating material in the petitioner's possession justifies bail
  • Whether the petitioner poses a risk of tampering with evidence or witnesses
