BAIL GRANTED

Holding

The Court granted bail to the petitioners subject to a monetary bond, sureties and strict conditions under Section 438(2) of the CrPC.

Summary

The petitioners, Raushan Kumar Verma and Shyam Sundar, were arrested in connection with FIR No.310 of 2025 alleging assault with deadly weapons under Sections 109, 115(2), 126(2), 352 and 3(5) of the BNS, 2023. They applied for bail, claiming innocence and that the alleged injury to the informant was minor and stemmed from a petty electricity‑line dispute. The prosecution opposed bail, highlighting that Raushan has one prior conviction and Shyam has four prior convictions. The High Court, after considering the facts and the seriousness of the offences, granted bail on the condition of a Rs 10,000 bond with two sureties, subject to Section 438(2) of the CrPC and several compliance conditions, including cooperation with the trial and verification of criminal antecedents. The order also empowered the trial court to cancel bail if the petitioners tamper with evidence, witnesses, or conceal their antecedents.

Issues considered

  • Whether bail should be granted to the accused despite the gravity of the offences under the BNS, 2023 and their prior criminal antecedents
  • Whether the conditions imposed under Section 438(2) of the CrPC are sufficient to safeguard the trial process
