Patna High Court

Pappu Yadav @ Pappu Kumar YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioners.

Summary

Petitioners Pappu Yadav and Shivnath Yadav sought anticipatory bail fearing arrest in a case alleging assault, robbery and other offences under the B.N.S. They contended that the victim suffered no injury, the informant was unreliable and had a criminal background, and that they themselves had a clean antecedent. The State opposed the bail on the ground of the seriousness of the alleged offences. The Court examined the credibility of the informant and the lack of demonstrable injury, and noted the petitioners' clean record. Relying on Section 438(2) of the Code of Criminal Procedure and Section 482 of the B.N.S., the Court held that bail was appropriate. Consequently, the application for anticipatory bail was allowed, directing the petitioners to be released on a bond of Rs.10,000 with two sureties, subject to the usual conditions.
