Patna High Court

Md. RahmatversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of a Rs. 10,000 bond with two sureties.

Summary

The petitioner, Md. Rahmat, was arrested on 17 February 2026 in connection with a case alleging violation of Section 30(a) of the Bihar Prohibition and Excise Act, based on the seizure of 190.355 litres of foreign liquor. He contended that he has a clean antecedent, was falsely implicated, and that the seizure was recorded by police witnesses in breach of Sections 103 and 105 of the Bihar Narcotic Substances Act, 2023. The State opposed bail, but the court noted the procedural lapses and the petitioner’s lack of prior record. Consequently, the court granted bail on a bond of Rs. 10,000 with two sureties, subject to conditions of cooperation, presence in court, and non‑tampering with evidence or witnesses. The bail order also directed verification of the petitioner’s criminal antecedents without delaying the release.

Issues considered

  • Whether the petitioner is entitled to bail despite the alleged violation of Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether non‑compliance with Sections 103 and 105 of the Bihar Narcotic Substances Act, 2023, warrants bail.
  • Whether the petitioner’s clean antecedent and alleged false implication justify bail.

been made from the bag in question and altogether 190.355
