The court held that despite the seriousness of the charges and the earlier denial of anticipatory bail, the petitioner is entitled to regular bail upon furnishing the prescribed bond and sureties, subject to attendance conditions.
Summary
Jairam Panjiyara was charged with offences under Sections 147, 148, 149, 341, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act for allegedly surrounding an informant’s house and firing indiscriminately. He had earlier obtained anticipatory bail from a coordinate bench, conditioned on verification of antecedents, but the verification revealed a pending case and the bail bonds were not accepted, leading to his surrender and custody from 13 May 2026. The petitioner subsequently applied for regular bail. The Court examined the seriousness of the charges, the prior denial of anticipatory bail, and the petitioner’s right to liberty, and decided to grant bail with a monetary bond and sureties. The bail order imposed a condition that the petitioner must attend the Fullidumar Police Station on the first and third Sundays of each month, with non‑compliance leading to cancellation of bail.

- Whether bail can be granted for offences under Sections 147, 148, 149, 341, 307, 504 IPC and Section 27 Arms Act
