Bail is granted to the petitioner subject to a bond of Rs.10,000 with two sureties, a donation of Rs.25,000 to a charitable institution, and mandatory weekly police station attendance.
Summary
Akash Kumar was arrested in connection with the recovery of 80 litres of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise Act, 2022. He had been in custody since 21 May 2026 and claimed innocence, offering to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed his bail application. The Court, after considering the facts and submissions, granted bail on a bond of Rs. 10,000 with two sureties of the same amount, conditioned on the deposit of Rs. 25,000 to the Ramakrishna Mission Ashram and proof of the receipt, as well as mandatory weekly attendance at the police station. The bail bonds are to be verified and any default in appearance will lead to cancellation. The order reflects the Court’s discretion to grant bail with stringent conditions in a prohibition offence.
Issues considered
- Whether bail should be granted to the accused in an offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2022
- Whether the conditions imposed (bond, sureties, charitable donation, police station attendance) are appropriate and sufficient
