The application for regular bail is dismissed as there is no ground to review the earlier order.

Summary

The petitioner, Sonu Kumar Sharma, applied for regular bail for an alleged offence under Section 392 of the Indian Penal Code, relating to a robbery in Budha Colony. This was his second bail application after an earlier denial on 25 September 2024. The prosecution alleges that unknown assailants looted cash and documents, and the petitioner’s name emerged during investigation; charges have not yet been framed. The petitioner, who has 24 prior criminal antecedents and has been in custody since 11 August 2023, argued that bail should be granted. The Court found no ground to revisit its earlier order and dismissed the bail application, directing the lower court to expedite trial and frame charges promptly.

Issues considered

  • Whether the petitioner is entitled to regular bail in the pending case under Section 392 IPC
  • Whether the earlier bail denial can be reviewed on the basis of lack of charge framing
  • Whether the petitioner’s criminal antecedents preclude bail
