Patna High Court

Prince Kumar @ Sahil @ Sahil KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that no fresh ground for bail existed and therefore dismissed the petitioner's bail application.

Summary

The petitioner, Prince Kumar, was charged under Sections 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act for allegedly killing two persons in broad daylight, with his name emerging from a co-accused's self‑inculpatory statement and being implicated in eleven other serious cases. He applied for regular bail, which had previously been denied on 30 July 2025. In the present hearing, the petitioner sought a fresh ground for bail, but the court found no new material or change in circumstances. Considering the gravity of the murder and the lack of fresh grounds, the court upheld its earlier decision and dismissed the bail application. The trial court was directed to expedite the trial and frame charges accordingly.

Issues considered

  • Whether the petitioner is entitled to regular bail for offences under Sections 302, 120B IPC and Section 27 Arms Act.
  • Whether any fresh ground exists to merit a review of the earlier bail denial.
