Patna High Court

Munna RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to cash bond, sureties, a charitable donation, and regular police‑station attendance.

Summary

Munna Rai was arrested in connection with the seizure of 100 litres of illicit liquor, alleged to be an offence under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner applied for bail, claiming innocence and offering to donate Rs.25,000 to a charitable organization without admitting guilt. The State opposed the bail application. The Court, after considering the facts and submissions, ordered the release of the petitioner on bail upon furnishing a cash bond of Rs.10,000 with two sureties of the same amount, and conditioned the bail on a donation of Rs.25,000 to the Ramakrishna Mission Ashram and regular attendance at the police station. The bail bonds are to be accepted after verification of the donation receipt, and any default in attendance will lead to cancellation of bail.
