BAIL REJECTED

Holding

Anticipatory bail was denied as the nature of the accusations and post‑mortem report warranted custody.

Summary

The petitioners, who are agnates of the informant, sought anticipatory bail after being implicated in a FIR alleging they, along with unknown persons, assaulted the informant's son, leading to his death. The FIR, dated 15-06-2024, charges them under Sections 147, 341, 323, 302 and 506 of the Indian Penal Code. The petitioners claim innocence, citing a pending property dispute and a police final report stating lack of evidence against them. The informant contended that the petitioners were present at the scene, armed, and that the post‑mortem confirmed death due to external injuries. The Court, considering the seriousness of the alleged offences and the post‑mortem findings, refused the anticipatory bail application.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under the circumstances of the FIR and post‑mortem report
  • Whether the evidence on record is sufficient to justify denial of anticipatory bail
