Holding

The Court allowed the application for anticipatory bail, directing the petitioner to surrender within four weeks and furnish the required bond and sureties.

Summary

Rampravesh Yadav applied for anticipatory bail after learning that he might be arrested in connection with PS Andhramath Case No. 106 of 2025, which alleges offences under the Bharatiya Nyaya Sanhita, 2023 and the Arms Act. The prosecution alleges that he assaulted an informant and caused injury to Umakant Mandal, but the petitioner claims innocence and points out that no incriminating article was recovered from him. The State opposed the bail application. The Court examined the facts, the nature of the alleged offences and the conditions under Section 482(2) of the BNSS, and decided to grant anticipatory bail. The order directs the petitioner to surrender within four weeks, furnish a bail bond of Rs.10,000 and two sureties of the same amount, subject to the stipulated conditions. The bail is to be released by the lower court where the case is pending.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the Bharatiya Nyaya Sanhita, 2023.
  • Whether the allegations of assault and offences under the Arms Act constitute a ground to deny anticipatory bail.
