Shesh Nath Dwivedi @ TinkuversusState Of Bihar and Anr

Decided
Disposal
DISMISSED

Holding

The court held that there was no ground to cancel the anticipatory bail as no allegation of tampering with evidence was substantiated.

Summary

The petitioner, Shesh Nath Dwivedi, filed an application seeking cancellation of the anticipatory bail granted to the respondent, Monu Dubey, in a case involving offences under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner alleged that the respondent had tampered with evidence, justifying revocation of bail. The court examined the case records and found no specific allegation or evidence of tampering by the respondent. Consequently, the court concluded that there was no legal ground to interfere with the earlier anticipatory bail order. The application for cancellation was therefore dismissed, leaving the anticipatory bail in force.
