Patna High Court

Rajeshwar Sahani @ Guddu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted as the recovery of illicit liquor does not prima facie establish the petitioner’s possession.

Summary

The petitioner, Rajeshwar Sahani, was named in an FIR for alleged illegal manufacturing and trading of illicit liquor, with 130.200 litres recovered from a motorcycle. The prosecution’s case relied on the testimony of a co-accused, and the recovered liquor was not found in the petitioner’s physical possession. The petitioner argued that he had no direct connection to the motorcycle and maintained a clean antecedent. The learned Assistant Public Prosecutor opposed bail, but the court noted that the recovery did not prima facie link the petitioner to the contraband. Consequently, the court directed that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bihar Narcotic and Smuggling Act.

Issues considered

  • Whether the petitioner’s arrest and continued detention are justified in the absence of physical possession of the illicit liquor.
  • Whether bail should be granted under Section 438(2) of the Cr.P.C. given the facts of the case.
