Patna High Court

Ravikant @ Chhotu Sharma @ Ravikant KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner subject to specified conditions.

Summary

The petitioner, Ravikant Sharma, was arrested in a case registered under Section 303(2) of the Bharatiya Nyaya Sanhita, 2023, concerning the theft of a car. The prosecution alleged that four persons, including the petitioner, confessed to the crime, though no incriminating material was recovered from the petitioner. The petitioner, who has been in judicial custody since June 2025 and has eight pending criminal cases, sought regular bail, arguing innocence and noting that two co‑accused had already been granted bail. The State opposed the bail application. The High Court, after considering the facts and submissions, granted regular bail on a cash bond of Rs.10,000 with two sureties, imposing conditions such as cooperation with the trial, regular appearance before the police, and restrictions on tampering with evidence. The application was allowed.

Issues considered

  • Whether the petitioner is entitled to regular bail under Section 303(2) of the Bharatiya Nyaya Sanhita, 2023 despite alleged confessions and multiple pending cases.
  • Whether the conditions imposed by the court are appropriate for granting bail in a serious offence.
