The court granted regular bail to the petitioner.

Summary

The petitioner, Dolly Kumari, sought regular bail in a case under Sections 8(c) and 21(b) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, where 15.65 g of contraband was allegedly recovered from her house. Her counsel argued that the seized material was not in her possession, that the seizure list was prepared by police officers who failed to comply with Section 105 of the Bihar Narcotic Substances (Control) Act, and that the quantity, though more than a ‘small quantity’, was far below a commercial amount. The State opposed bail, citing a prior similar offence. The court considered the lack of direct possession, the procedural lapse, and the petitioner’s personal circumstances, and decided to grant bail on a bond of Rs 10,000 with two sureties, subject to the satisfaction of the Special Judge handling NDPS matters.

Issues considered

  • Whether the petitioner is entitled to regular bail under the NDPS Act for alleged possession of 15.65 g of contraband.
  • Whether non‑compliance with Section 105 of the Bihar Narcotic Substances (Control) Act by the police affects the grant of bail.
  • Whether the petitioner’s prior criminal antecedent warrants denial of bail.
