Patna High Court

Dhaniklal Paswan @ Dhanik Lal PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioners subject to bond and surety conditions.

Summary

The petitioners, Amit Kumar Yadav and Dhaniklal Paswan, applied for regular bail in a theft case (Bahera P.S. Case No. 453 of 2024) where they were charged under Sections 305(a) and 331(4) of the BNS. The prosecution alleged that unknown persons broke into a house on 23‑11‑2024 and stole goods worth Rs. 10 lakhs. The petitioners contended they were falsely implicated and have been in custody for about a year, with no substantive evidence against them except a confessional statement in an unrelated case. The court examined the lack of material evidence and the prolonged pre‑trial detention. It ordered that the petitioners be released on bail upon furnishing a bond of Rs. 10,000 each with two sureties, subject to their cooperation in the trial.

Issues considered

  • Whether the petitioners are entitled to regular bail despite a year-long custody and lack of substantive evidence.
