Decided

DISMISSED

Holding

The court refused to grant bail and dismissed the petitioner's application.

Summary

Vikash Kumar was arrested for looting a Bandhan Bank collection agent and charged under Sections 382 and 34 of the Indian Penal Code. He confessed to the offence and is also implicated in ten other serious cases, having been in custody since August 13, 2024. The petitioner applied for regular bail, having previously been denied bail on April 9, 2025. The State opposed the bail, emphasizing the gravity of the allegations and the commencement of trial. Justice Sandeep Kumar, noting the seriousness of the offence, the confession, and the multiple pending cases, declined to review the earlier order and dismissed the bail application.

Issues considered

  • Whether bail should be granted to the petitioner despite his confession and involvement in multiple serious offences
  • Whether the commencement of trial and framing of charges preclude the grant of regular bail
