Holding

Anticipatory bail was not granted as the court was not inclined to relax bail in view of the nature of the allegations.

Summary

Rajan Kumar, a gold valuer, applied for anticipatory bail fearing arrest in a case (Fatuha PS Case No. 820 of 2024) alleging cheating of a bank under IPC Sections 467, 468, 471, 406 and 420. The prosecution alleged that he performed a wrong valuation of gold to defraud the bank. The petitioner argued that he feared arrest and sought protection through anticipatory bail. The Patna High Court, after hearing counsel, held that given the seriousness of the allegations, anticipatory bail could not be granted. The application was dismissed and the petitioner was directed to surrender within two weeks and seek regular bail, failing which the police were authorized to arrest him.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in view of the alleged offences under Sections 467, 468, 471, 406 and 420 IPC.
