The Court ordered the release of the petitioner on regular bail upon furnishing the prescribed bail bond and sureties.

Summary

The petitioner, Sahul Kumar, was arrested in a case registered under sections 137(2) and 140(3) of the BNS. The prosecution alleged that the daughter of an informant, a minor, went missing and later gave a statement under section 183 of the BNSS indicating she liked the petitioner and wanted to marry him. The petitioner’s counsel argued that the victim’s statement contained no allegation of any overt act against the petitioner, that she denied medical examination, and that the petitioner has no criminal antecedents and has been in judicial custody since 24‑11‑2025. The State opposed bail on the ground that the victim is a minor. After hearing both sides, the Court found the circumstances warranted regular bail and ordered the petitioner released on a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail in a case under sections 137(2) and 140(3) of the BNS given the victim’s statement and minor status.
