Decided
Disposal
BAIL GRANTED

Holding

The application for regular bail is allowed.

Summary

The petitioners, Anmol Kumar and Ankit Kumar, were arrested in connection with a kidnapping case registered as Dhaka Police Station Case No. 273/2025, alleged to be offences under Sections 140(1) and 3(5) of the B.N.S. The petitioners contended that they were falsely implicated, that the victim’s statement did not indicate a kidnapping for ransom, and that the victim did not name them as perpetrators. They highlighted their clean antecedents and the fact that they had been in custody since 21‑09‑2025, undertaking to cooperate with the trial. The State, represented by the Additional Public Prosecutor, opposed the grant of regular bail. After considering the facts, the Court held that the petitioners were entitled to regular bail and ordered their release upon furnishing a bail bond of Rs.10,000 with two sureties of the same amount. The order was pronounced by Justice Sandeep Kumar on 09‑04‑2026.

Issues considered

  • Whether the petitioners are entitled to regular bail for offences under Sections 140(1) and 3(5) of the B.N.S. despite the kidnapping allegation
  • Whether the victim’s statement and the petitioners’ clean antecedent justify the grant of bail
