Holding

The Court held that the petitioner is entitled to regular bail and ordered his release on bail with conditions.

Summary

The petitioner, Sujit Yadav, was arrested in connection with a kidnapping case (Jamui P.S. Case No. 549 of 2025) and charged under Sections 140(2), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged his involvement, but the victim examined as PW‑1 did not identify the petitioner nor name him as the perpetrator. The petitioner, represented by Mr. Prabhat Kumar Singh, pleaded innocence and sought regular bail, having been in custody since 13‑12‑2025. The State, represented by Mr. Shyam Kumar Singh (APP) and Mr. Uday Pratap Singh, opposed the bail. The Court, after considering the lack of identification and the circumstances, allowed the bail application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties and to cooperate with the trial. The order emphasized that the observations were prima facie and would not affect the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the kidnapping charge under the Bharatiya Nyaya Sanhita.
  • Whether the absence of victim identification of the petitioner justifies the grant of bail.
