Prince Singh @ Navin Kumar SinghversusThe State of Bihar

Holding

The court held that, given the minor nature of the alleged assault, the petitioner’s whistle‑blower status and lack of serious injury, bail could be granted.

Summary

Prince Singh, a resident of Buxar, was charged under multiple sections of the Bharatiya Nyaya Sanhita, 2023 for allegedly assaulting and threatening an informant who is a contractor. The informant alleged that Singh pointed a pistol at him, snatched his gold chain and demanded extortion. Singh’s counsel argued that the informant was a corrupt contractor, that Singh was a whistle‑blower, that the alleged injuries were minor and that he had been in custody since 3 October 2025. The State opposed bail. After hearing both sides, the court considered the nature of the allegations, the petitioner’s claim of whistle‑blowing and the lack of serious injury, and decided to grant bail on a bond of Rs 10,000 with two sureties.

Issues considered

  • What is the appropriate bail disposition for the petitioner charged under sections of the Bharatiya Nyaya Sanhita, 2023?
  • Does the petitioner’s claim of being a whistle‑blower and the alleged minor nature of injuries justify granting bail?
