Holding
The petitioners are entitled to regular bail subject to a bond and sureties.
Summary
The petitioners, three brothers, were charged under multiple sections of the Bihar Penal Code for a violent incident that resulted in the death of an informant's husband and brother-in-law, and the alleged theft of a gold chain and cash. They sought regular bail, contending that they were falsely implicated, had clean antecedents, and had been in custody longer than other co‑accused who had already been released on bail. The State opposed the bail on the seriousness of the offences. The court noted the precedent of bail being granted to other co‑accused in similar circumstances and considered the petitioners' longer detention and lack of prior record. Consequently, the court ordered that the petitioners be released on bail upon furnishing a bond of Rs 10,000 each with two sureties of equal amount, subject to cooperation with the trial. The bail was conditioned on their availability for court proceedings.
Issues considered
- Whether the petitioners are entitled to regular bail despite being charged with serious offences including murder and robbery
- Whether the grant of bail to other co‑accused in the same case influences the petitioners' right to bail
- Whether the length of custody and the petitioners' clean antecedents justify bail
Subjects
- regular bail
- serious offences
- murder
- theft
- custody period
- clean antecedents
- criminal procedure
