Patna High Court

Manas Sinha @ Manas MadhuramversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner subject to the stipulated conditions.

Summary

Manas Sinha sought anticipatory bail fearing arrest in a case registered under multiple IPC provisions, the POCSO Act and the SC/ST Act. The allegations involved an attempt to molest a minor, but the investigation revealed that the informant was an advocate with personal disputes, leading to a suggestion that the charge-sheet be filed under sections relating to theft and causing hurt. Both the State and the informant's counsel opposed the bail. The High Court, after considering the facts and submissions, ordered that the petitioner be released on bail if arrested or surrendered within six weeks, upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482 of the Code of Criminal Procedure and Section 438(2). The order effectively granted anticipatory bail with specified financial and procedural conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite serious allegations under the IPC, POCSO Act and SC/ST Act.
