Patna High Court

Jibrail Kuraisi @ Yuvrail KuraisiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioners subject to prescribed bail bond and conditions.

Summary

The petitioners, Jibrail Kuraisi and Nasruddin Kuraisi, were implicated in a FIR alleging illegal operation of a slaughterhouse dealing in cow flesh, violating Sections 429, 153(A), 295(A), 34 of the IPC, Section 11 of the Animal Cruelty Act, 1960 and Section 345 r/w 429 of the Bihar Municipal Act, 2007. They contended that they were merely labourers loading and unloading goods and had no involvement in the illegal business, arguing that their arrest was based on communal suspicion. The State opposed their anticipatory bail application. The High Court, after considering the submissions, granted anticipatory bail, directing that if arrested within eight weeks the petitioners be released on a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The order also referenced a prior anticipatory bail granted to a co‑accused in a similar matter.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners accused under IPC, Animal Cruelty Act and Bihar Municipal Act.
  • Whether the petitioners' alleged role as mere labourers negates the likelihood of them committing the alleged offences.
  • Whether the conditions imposed under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 are appropriate.

                                       ORAL ORDER

3 18-03-2026 Heard learned counsel for the petitioners and the

                   State.

                                2. Petitioners apprehend arrest in a case registered for

                   the offences punishable under Sections 429, 153(A), 295(A), 34

of the Indian Penal Code & Section 11 of Animal Cruelty Act,

                   1960 & 345 r/w Section 429 Bihar Municipal Act, 2007.

                                3. As per F.I.R., all the named accused persons

including these petitioners were running a slaughter house

without proper permission and unauthorizedly, dealing with cow

flesh. It is alleged that these petitioners and several others were

responsible for transportation of cow meat from slaughter

                   house.

                       4. Learned counsel for the petitioners submits that

petitioners are innocent and have committed no offence.

Petitioners have got no concern with the illegal business of cow

flesh and they are simply labours, engaged in loading/ unloading

of goods in the vehicle. Petitioners have falsely been implicated

in this case merely on the basis of suspicion as they are residents

of Quraishi Mohalla, which is predominantly inhibited by

Muslims. Similarly situated co-accused, namely, Kammu

Quraishi has already been granted anticipatory bail by this Court

vide order dated 12.05.2023 passed in Cr. Misc. No. 7029 of

          2023.

                       5. Learned A.P.P. for the State vehemently opposed

          the bail application.

                       6. Considering the aforesaid facts and circumstances

of the case, this anticipatory bail is allowed and it is ordered that

let the above named petitioners in the event of their

arrest/surrender before the court below within a period of eight

weeks from today, be enlarged on bail on furnishing bail-bond

of Rs. 10,000/- (ten thousand) each with two sureties of the like

amount each to the satisfaction of Additional Chief Judicial

Magistrate I, Bikramganj, Rohtas in connection with
