Holding
Anticipatory bail is granted to the petitioner subject to conditions and the posting of bail bonds.
Summary
The petitioner, Ravindra Paswan, sought anticipatory bail after being implicated in a case (Vishnupad PS Case No. 206 of 2024) under multiple sections of the Bihar Negotiable Substitution (B.N.S.) including offences of waging war against the state, murder, and assault. He claims the allegations stem from a personal dispute where he allegedly assaulted an informant with a knife, but asserts his innocence and that the injuries were minor. The State opposed the bail, arguing the seriousness of the charges. The court considered the facts, the possibility of arrest, and the provisions of Section 482(2) of the B.N.S. for anticipatory bail. It ordered that the petitioner be released on anticipatory bail upon surrendering within four weeks, posting a bail bond of Rs.10,000 with two sureties, subject to conditions imposed by the Judicial Magistrate.
