The FIR is quashed as the parties have reached a lawful compromise and the offences are not non‑compoundable in the circumstances.

Summary

The petitioners, three women and a man, filed an application seeking quashment of FIR No. 501 of 2020 registered at Bairiya Police Station for offences under Sections 323, 341, 504, 406, 420, 120B and 384 of the IPC and Section 67 of the Information Technology Act. They contended that the dispute stemmed from matrimonial discord and that they had reached a compromise with the opposite party outside court without any threat, coercion or promise. The opposite party, represented by the State and a private respondent, opposed the quashment. The court examined whether the offences, particularly those under Section 384 IPC and Section 67 IT Act, were compoundable. Finding that the parties had amicably settled the matter and that justice required recognizing the compromise, the court ordered the FIR to be quashed. The application for quashment was therefore allowed.

Issues considered

  • Whether the FIR registered for offences under Sections 323, 341, 504, 406, 420, 120B, 384 IPC and Section 67 IT Act can be quashed on the ground of compromise.
  • Whether the offences under Section 384 IPC and Section 67 of the Information Technology Act are compoundable.
