Holding

The court granted regular bail to the petitioner, directing release on a bail bond with conditions.

Summary

The petitioner, Deepak Pandey, was charged under section 309(4) of the Bihar Negotiable Instruments Act for allegedly assaulting an informant on a railway track and snatching his mobile phone. He had been remanded in custody since 30 August 2025, had given a confessional statement, but no physical evidence was recovered and no Test Identification Parade was conducted. The petitioner claimed innocence and that the FIR was lodged against unknown miscreants, while the State opposed bail citing five prior criminal antecedents. The court examined the lack of material evidence and the petitioner’s prolonged custody, and decided to grant regular bail. He was released on a bail bond of Rs.10,000 with two sureties, subject to cooperation with the trial and presence before the trial court on all dates.

Issues considered

  • Whether regular bail should be granted to the petitioner under section 309(4) of the Bihar Negotiable Instruments Act in view of the absence of physical evidence and lack of a Test Identification Parade.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.
