Babua SahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner under Section 482 of the BNSS, 2023, subject to bond and verification conditions.

Summary

The petitioner, Babua Sah, aged about 57, was named in an FIR relating to a land dispute where he was alleged to have assaulted an informant with a lathi. He sought anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, fearing arrest in connection with multiple IPC offences. The petitioner argued innocence, his advanced age, and pointed out that co‑accused had already been granted anticipatory bail by the same and other benches. The State opposed the bail but did not contest the precedent of bail being granted to others. The Court, considering the facts, the petitioner’s claim of innocence, and the prior bail orders, granted anticipatory bail subject to a Rs.30,000 bond and conditions for verification of criminal antecedents.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482 of the BNSS, 2023 in view of the allegations and prior bail to co‑accused.
