Patna High Court

Sanjiv Singh @ Sanjiv Ram @ Karu RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to a bond of Rs.10,000 and two sureties of equal amount, with the condition of cooperation in the trial.

Summary

The petitioner, Sanjiv Singh, was arrested in connection with a case registered under Section 304/34 of the Indian Penal Code for the alleged killing of his wife. He claimed innocence, stating that the informant who lodged the FIR was not an eye‑witness and that he has a clean antecedent. The State opposed his bail, but the High Court considered the circumstances, including his custody since 03‑12‑2025 and lack of prior convictions. The Court allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties of the same amount and to cooperate with the trial. The order was limited to the bail issue and did not express any opinion on the merits of the underlying criminal case.

Issues considered

  • Whether bail should be granted to the accused in a case of alleged culpable homicide under Section 304/34 IPC, considering the nature of the offence, custody, and the petitioner's clean antecedent.
