Mahtab AlamversusThe State of Bihar

Holding

The court granted regular bail to the petitioner, finding no sufficient material to justify continued detention.

Summary

The petitioner, Mahtab Alam, was arrested in connection with a kidnapping alleged under section 140(3) of the B.N.S.S. and has been in judicial custody since 29 April 2025. The prosecution alleged that a vehicle owned by the petitioner was used in the kidnapping, but the informant’s uncle has not yet returned from civil court and the confessional statement of a co-accused did not name the petitioner. The petitioner argued that he merely lent his Xylo vehicle to a third party, has no criminal antecedents, and is not mentioned in any confessional statement. The State opposed the grant of regular bail. After hearing both sides, the court found insufficient evidence linking the petitioner to the crime and ordered his release on regular bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail under section 140(3) of the B.N.S.S. given the circumstances of the case
  • Whether the ownership of the vehicle used in the alleged kidnapping implicates the petitioner
