Patna High Court

Sanjeet Kumar @ Sanjit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to bail bond, sureties and a monthly maintenance condition.

Summary

The petitioner, Sanjeet Kumar, sought anticipatory bail fearing arrest in a case (Mushrigharari P.S. Case No. 54 of 2023) involving offences under IPC sections 341, 323, 498A, 379, 506, 34 and Section 3 of the Dowry Prohibition Act, alleged to be for assault and torture to demand dowry. He contended that he was falsely implicated and that no specific allegation of torture or dowry demand was made against him. The State opposed the bail. Relying on the Supreme Court’s guidelines in Arnesh Kumar v. State of Bihar (2014) 8 SCC 273, the High Court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to pay a monthly maintenance of Rs.7,000 to the complainant, subject to the family court’s decision. The order also warned that non‑compliance could lead to cancellation of bail. The bail order was communicated to the District & Sessions Judge for implementation.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the CrPC in view of the serious offences alleged.
  • Whether the guidelines laid down in Arnesh Kumar v. State of Bihar are applicable to restrain unnecessary arrest.
  • Whether the petitioner can be conditioned to pay maintenance to the complainant while on bail.
